1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Le Nez Perfume Bar LLC ("Le Nez," "we," "our," or "us"), located at 2657 N Clark St, Chicago, IL 60614.

By using our website at lenezperfumebar.com, placing an order, booking a fragrance session, or subscribing to the Scent Society membership, you confirm that you are at least 18 years old and accept these Terms in full.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with a revised "Last updated" date. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

2. Products & Pricing

• All Le Nez fragrances are handcrafted Extraits de Parfum at 30ml and priced at $44.99 unless otherwise stated during a promotional period.
• Prices are listed in US dollars and are subject to change without notice. Price changes do not affect orders already placed and confirmed.
• Product images are representative only. Bottle aesthetics may vary slightly from batch to batch due to the handcrafted nature of our products.
• We reserve the right to limit quantities of any product, cancel orders due to suspected fraud, or decline service at our discretion.
• Discovery sets and promotional items are final sale and not subject to our standard return policy.

3. Orders & Payment

• Orders are accepted 24 hours a day through lenezperfumebar.com. Each order constitutes an offer to purchase subject to our acceptance.
• Order confirmation emails are automated acknowledgements and do not constitute acceptance. Acceptance occurs when your order ships.
• Platform: Our store is powered by Shopify Inc. By placing an order you also agree to Shopify's Terms of Service at shopify.com/legal/terms.
• Payment is processed by Stripe, Inc. We accept Visa, Mastercard, American Express, Discover, and Apple Pay.
• We never store, transmit, or have access to your card number. All payment data is handled exclusively by Stripe (PCI DSS Level 1 certified).
• If your payment is declined, no order is created. You will be notified at checkout to try a different payment method.
• Sales tax is applied where required by law based on your shipping address.

4. Shipping & Delivery

• All orders are hand-poured to order. Please allow 1–2 business days for atelier processing before shipment.
• Standard US shipping: 3–5 business days. Expedited options available at checkout.
• We ship to all 50 US states. International shipping is currently limited — contact us for specific inquiries.
• Shipping charges are non-refundable except in cases of Le Nez error or damaged goods.
• Scent Society members receive complimentary shipping automatically applied at checkout.
• Risk of loss transfers to you upon handoff to the shipping carrier. We recommend selecting signature confirmation for high-value orders.
• For orders reported as delivered but not received, please contact us within 5 business days. We will assist in filing a carrier claim.

5. Returns & Refunds

Our complete return and refund policy is available at lenezperfumebar.com/pages/refund-policy/. Key terms:

• Full-size, non-customized fragrances may be returned within 14 days of delivery if completely unopened and unused.
• Bespoke and personalized creations are non-returnable and non-refundable.
• Damaged orders must be reported within 48 hours of delivery with photographic evidence.
• Approved refunds are processed to the original payment method within 5–7 business days.

6. Event Bookings

• All bookings for private sessions, group workshops, private events, and corporate activations require a non-refundable deposit to secure the date.
• The deposit amount and total fee are disclosed at the time of booking confirmation.
• Rescheduling is permitted free of charge with a minimum of 14 days advance notice.
• Cancellations within 14 days of the scheduled event forfeit the deposit. No credit is issued for no-shows.
• Le Nez reserves the right to cancel or reschedule events due to unforeseen circumstances. In such cases, clients will receive a full refund of any deposits paid or the option to reschedule at no additional cost.
• Guests attending Le Nez events must be 18 years or older unless a specific minor-friendly event is designated.

7. Scent Society Membership

• The Scent Society is a recurring subscription service billed monthly via Recharge Payments.
• By selecting a membership tier, you authorize Le Nez to charge your payment method on a recurring monthly basis at the stated tier price.
• You may cancel your membership at any time before your next renewal date with no cancellation fee. Access to member benefits continues through the end of the paid billing period.
• Refunds are not issued for billing cycles that have already been processed and for which physical goods or digital benefits have been deployed.
• Membership benefits (discounts, free shipping) are non-transferable and applicable to your account only.
• The Birthday Ritual gift requires a valid birth month on file at the time of the benefit period. We are not responsible for missed rituals due to incorrect or missing birth month information.
• Le Nez reserves the right to modify membership tiers, benefits, and pricing with 30 days advance notice by email to active members.

8. Intellectual Property

• All content on lenezperfumebar.com — including fragrance names, descriptions, photographs, design, branding, and copy — is owned by Le Nez Perfume Bar and protected by copyright, trademark, and trade dress law.
• Custom fragrance formulas created in our atelier remain the intellectual property of Le Nez. You are granted a personal, non-exclusive license to use your formula for personal fragrance purposes only.
• You may not reproduce, distribute, commercially exploit, or create derivative works from our content without prior written permission.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

• Le Nez Perfume Bar shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our products, services, or website.
• Our total liability for any claim arising from these Terms or your use of our services shall not exceed the total amount you paid to us in the 12 months preceding the claim.
• We make no warranties, express or implied, regarding the fitness of our fragrances for any particular purpose beyond personal fragrance use.
• Fragrance sensitivity and allergic reactions are individual. We strongly recommend testing any new fragrance on a small area of skin. We are not liable for adverse skin reactions to fragrances used as directed.

10. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right under these Terms does not constitute a waiver of that right.
